What Happens When an Old Mortgage Appears in an Alabama Title Search?

Finding an old mortgage in an Alabama title search does not necessarily mean the homeowner still owes money. Sometimes a loan was paid years ago, but the satisfaction or release was never properly recorded. From the public record, however, that mortgage may still appear to affect the property until the title issue is addressed. Alabama law recognizes the satisfaction of mortgage debt and provides procedures for causing satisfied mortgages to be released from the title record.

The first step is usually determining whether the mortgage remains outstanding. The title or closing team may contact the lender, successor lender, or loan servicer to obtain a payoff or evidence that the debt was previously satisfied. Older mortgages can take longer to resolve because the original lender may have merged, changed names, transferred the loan, or gone out of business. 

This is one reason an early title search matters. Discovering an old mortgage several weeks before closing may be manageable. Discovering it the afternoon before closing can create unnecessary stress for the seller, buyer, lender, and Realtors. A title problem does not always mean the transaction is in danger — but it does mean someone needs enough time to solve it.
